On Thursday, Dec. 7, 2006, CMAA, the Construction Management Association of America, will present a one-hour webinar from 12:00–1:00 p.m. Eastern Time titled, “The Construction Manager’s Role in Administration of Schedule and Payment.”

This session will guide the construction manager through responsibilities and risks in monitoring the contractor’s progress. We will evaluate the role of the construction manager in ensuring a contractor’s compliance with its scheduling obligations, and provide recommendations to the construction manager faced with a contractor who is either behind schedule or who is failing to provide schedules which meet the contractual requirements. The session will advise the construction manager on its responsibilities in evaluating a contractor’s entitlement to progress payments, and identify practices that can expose a construction manager to liability for either over or under estimating a contractor’s true progress. Learn when it is appropriate to withhold payment from the contractor, and how this important tool can be applied without creating undue legal risk. The speaker will be Mark Berry, a partner in the Washington DC law firm of Peckar, Abramson Bastianelli & Kelley.
